responsible or otherwise liable for any exchange of personal information or
in person meeting. If you decide to meet someone off of Cowboys, we
suggest that you meet that person in a public arena. There are risks which
you assume when dealing with people who might be acting under false
pretenses; all of these risks are assumed by you. We do not screen, censor or
otherwise control the users of this service. Cowboys does not and
cannot control the behavior of the participants of this site.
ACCEPTABLE ONLINE ACTIVITY:
As a member, you acknowledge and agree to the following: Your membership is
for your sole, personal use only and that you are 18 years of age or older.
You may not authorize others to use your membership, and you may not assign
or otherwise transfer your account to any other person. You are solely
responsible for the content of information you post on the service or
transmit to other members. You will not post or transmit to other members any
item that is defamatory, inaccurate, abusive, obscene, profane, offensive
sexually oriented, threatening, harassing, racially offensive or illegal, or
any material that infringes or violates another's rights (including but not
limited to intellectual property rights and rights of privacy and publicity).
You will not include in your profile any of the following: telephone numbers,
street addresses, last names, offensive anatomical or sexual references,
offensive sexually suggestive or connotative language, any information that
is solicitous of any type of product or service. Cowboys reserves
the right to reject any profile that does not comply with these prohibitions.
No advertising or solicitation of other members to buy or sell any products
or services through Cowboys's service. You will not transmit any
chain letters or junk E-Mail to other members. You will not post, distribute
or reproduce any copyrighted material, trademarks or other proprietary
information without obtaining the prior consent of the owner of such
proprietary rights. Your usage of Cowboys must abide with all
applicable state and federal laws and regulations.
INDEMNITY BY MEMBER:
You agree to indemnify and hold harmless Cowboys, its officers,
directors, employees, agents and third parties, from any losses, costs,
liabilities and expenses (including reasonable attorney fees) relating to or
arising out of your use and activities while using Cowboyss
service, including breach by you of the terms of this agreement.
CONFIDENTIALITY OF INFORMATION SUPPLIED BY MEMBER:
Cowboys will keep all information supplied by you confidential
and any information you do not publicize
and shall use or disclose such information only for the purposes for which
such information was collected, or as required by law.
LIMITATION OF LIABILITY:
In no event will Cowboys be liable: To you for any incidental,
consequential or indirect damages (including but not limited to damages for
loss of data, loss of programs, cost of procurement of substitute services or
service interruptions) arising out of the use of or the inability to use the
Cowboys service, even if Cowboys or its agents or
representatives known or have been advised of the possibility of such damages
or to any person other than you. Notwithstanding anything herein to the
contrary, Cowboyss liability to you for any cause whatsoever and
regardless of the form of action will at all times be limited to the amount
paid by you to Cowboys, if any, for the service during the term of
your membership. In addition, Cowboys disclaims all liability,
regardless of the form of action, for the acts or omissions of other members
or users (including unauthorized users or "hackers") of the Cowboys
service.
